  The Board of County Commissioners of Kay County, Oklahoma, met in regular session at 9:00 o'clock a.m. on Monday, October 15, 2007, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma.  Notice of the meeting was posted for public information on October 12, 2007, at 8:30 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.
Chairman Schieber called the meeting to order.  Those present were as follows: Dee Schieber, Chairman; Laile Wilson, Vice-Chairman; Wayne Leven, Member; Will Clark, First Assistant District Attorney (ADA); Judy Barnes, Kay County Assessor; Christy Kennedy, Kay County Treasurer; Mary Ramey, Kay County Court Clerk; Everette Van Hoesen, Kay County Sheriff; Larry Klumpp, OSU Extension; Charles Abbott, Blackwell Journal Tribune; Sharon Rowen, Ponca City News; Tammy Reese, Kay County Clerk/Secretary (see sign in sheet).
Motion was made by Wilson and seconded by Leven approving regular meeting minutes of October 8, 2007.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Becky Adams presented her request for an address change to the commissioners. After much discussion it was concluded that since she was never assigned an address by the Assessor's office she could do so at this time.
Jail Issues:  Sheriff Van Hoesen reported 98 inmates as the jail count with 7 in Osage County.  Van Hoesen discussed the bed count number being raised from 108 to 147.  Van Hoesen said bunks have been picked up and are in the Sally Port; the damaged cell has been painted and they are still waiting for the glass to be installed.  He said Architect in Partnership (AIP) will send him a price list on lights so he can determine if it is more feasible to move lights around or replace with new.
Road and Bridge Projects, Circuit Engineering District (CED) #8:  Schieber distributed information to Commissioner's Leven and Wilson that he received at the CED meeting held in Woodward on October 11th.  The information contained percentages on bridge replacement costs, number of bridges replaced, and deficient or obsolete bridges.
Motion was made by Wilson and seconded by Leven to Table Creation of a Joint Airport Zoning Board for the Ponca City Municipal Airport.  ADA Clark suggested the commissioners table until they can discuss matters such as creation, dissolution, and answer any other questions or concerns.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Leven and seconded by Schieber to increase the fees on Line Permits from $100.00 to $500.00, effective immediately.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Wilson and seconded by Leven approving the following applications for Permit Line Installation on County Right-of-Way:  Permit #08-21, Installing a fiber optic telecommunications cable by trenching and boring, located beginning approximately 400' south of the NW corner of Section 34 T-26N, R1W proceeding south in the right of way for approximately 3300' to the American Tower Site, D#3.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Leven and seconded by Wilson approving the following September 2007 Monthly Reports:  Election Board; County Clerk; Public Health; Court Clerk ­ Newkirk Office, Blackwell and Ponca City Division.  Leven amended the motion to note them (instead of approving).  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Wilson and seconded by Leven approving the following Resolutions to Dispose of Equipment:  Res#7, 8-95, Treasurer's office, Hewlett Packard Fax Machine, junked; Res#7, 8-96, Public Health, Mita 3055 copy machine, junked.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Leven and seconded by Wilson approving the following Resolutions to Deposit:  Res#7, 8-91, Public Building Authority-$1,408.84, October 2007 rent; Res#7, 8-92, Highway, Dist#3-$20.00, rebate on Antivirus Software; Res#7, 8-93, Open Dump Reward-$10.00, September 2007 reward; Res#7, 8-94, Highway-$1,050.00, reimbursement for rock for Hubbs Estate.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Wilson and seconded by Leven approving the following Cash Fund Estimate of Needs and Request for Appropriation:  Public Building Authority-$1,408.84; Public Building Authority-Health-$2,234.40; Open Dump Reward-$10.00; Visual Inspection Reimbursement-$1,847.61.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Leven and seconded by Wilson approving the following Transfer of Appropriations:  Highway Maintenance., Dist#1-$29,513.32 to Highway Maintenance., Dist#2; Sheriff General, Personal-$9,400 to Part-time-$2,400.00 and Over-time-$7,000.00; Sheriff Commissary, Maintenance-$1,800.00 to Equipment-$1,200.00 and Capital Outlay-$600.00.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Commissioner Wilson discussed the Northwest District Meeting held in Buffalo and reported to those present Kay County will be hosting the spring Northwest District Meeting in March 2008.
Motion was made by Leven and seconded by Wilson to accept Bid#2007-45, selling used office equipment, County Clerk (one bid was made on each item); Blackwell Chamber of Commerce, $10, Four shelf metal storage unit; Judy Barnes, $10, Pressboard computer desk; Patsy Leyva, $20, general fireproof office desk; Heather Miller, $5, general fireproof office desk.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Motion was made by Leven and seconded by Wilson accepting the two lowest bids on Bid#2007-46, Road Rock, 1 12" Crusher Run (non-tested).  Whitaker Aggregates Inc. $4 per ton/Grant County, District #3, $5 per ton.  Motion carried:  Schieber, aye; Leven, aye; Wilson, aye.
Discussion was made concerning the Kay County Estimated General Fund Budget, FY 2007-2008.  Leven said after reviewing the budget containing estimated ad valorem collections and estimated expenditures for 2007-2008; he suggested going with 92% of the budget and leaving every office at same amount as last year with an increase of $75 per month for employees for the last seven months of remaining fiscal year.
No action was taken.
Leven recommended scheduling a special meeting with the Excise Board members to finalize figures and the budget.  The special meeting will be held Thursday or Friday of this week.
