NOTICE OF SALE OF STATE OWNED LAND
LEASE NO 100904
The State of Oklahoma ex rel. Commissioners of the Land Office
(CLO)
shall offer for sale at public auction the following described
School Trust
Land located in Kay County. Said public auction shall be held
August 14,
2007 at 10:00 am at the front door of the Kay County Courthouse,

S Main St., Newkirk, OK 74647, and subject to the following terms
and
conditions:
Legal Description: The NE/4 Section 16 Township 27N Range 1West
of the Indian Meridian, Kay County, containing 160 acres more
or less.
APPRAISED VALUE:$472,000.00
All bidders are required to register at the auction before submitting
a bid.
The land cannot be sold for less than the appraised value and
is subject to the rights of the current lessee. All associated
costs of sale including but not limited to the appraisal and
advertising are to be paid by the purchaser, and are in addition
to the purchase price. The CLO reserves the right to reject any
and all bids, and no bid is finally accepted until approved by
the Commissioners. The land is sold "as is, where is"
and is subject to all easements, rights of way and restrictions
of record. Prospective bidders are advised to inspect the land
before the sale. The CLO does not warrant access and all acres
are approximate. Lands near waterways are subject to accretion
and avulsion. The State of Oklahoma does not warrant title to
the land. The State reserves and retains all minerals and mineral
rights.
The land may be subject to a preference right to purchase which
may be
exercised only by the current lessee at the time of sale. This
preference
right allows the current lessee to match any given high bid at
the time of
sale using the two tier bidding system.Bidding will continue
until it ceases of its own accord.
The successful bidder shall remit no less than 10 percent of
the purchase
price and all of the associated costs at the time of sale. The
balance of the purchase price is due at or before closing. Also
at or before closing, if the purchaser is not the current lessee,
purchaser shall remit payment for the appraised value of the
improvements. All other lessee owned improvements which can be
removed without manifest injury to the land are to be removed
by lessee by closing. The closing shall be set upon Commission
approval of sale, receipt of full payment for land, improvements,
and as-sociated costs as well as compliance with notice of sale.
Possession shall be delivered at closing or no later than September
14, 2007. When all pay-
ments are received, the CLO will issue a Patent to the land.
If the successful bidder fails to pay the balance of the purchase
price, the
appraised value of the improvements or associated costs, or fails
to comply with the notice of sale, bidder shall forfeit all monies
paid to CLO as liqui-dated damages.
Announcements and corrections at time of auction may supersede
this notice.

Leven expressed concerns about Sheriff Van Hoesen's requests
to purchase new cars when the county is facing so many problems
in the jail, but Leven stated he had no control over how the

Election Ballots. Commissioners accepted the bid offered

Unscheduled public appearances: Kay County Treasurer, Christy
Kennedy, said she wanted to thank Commissioner Leven for checking
into the courthouse parking situation.
Kennedy and other officers had asked Commissioners in an earlier
meeting to find out how much it would cost to renovate and expand
parking in area behind (west) of the courthouse. Leven
contacted Evans and Associates and reported back to officers
their estimate.
Kennedy also mentioned that officers had previously discussed
the possibility of trying to receive a grant, and researching
other probable ways to fund the project.
Orva Rothgeb asked Commissioners what can be done about the major
dumping problems throughout the county; what the regulations
are and who is responsible to try and stop the dumping?
Commissioner Leven told Ms. Rothgeb it would fall under the Sheriff's
Department.
ADA Will Clark stated under "Unscheduled Public Appearances"
the need to be careful talking about non-agenda items. He
explained, comments from the audience may be heard and briefly
discussed. If further discussion is needed the topic may
be an item on a future Agenda.
Clark went on to say illegal dumping needs to be brought
to the attention of the Sheriff. Enforcement of crimes
in the county is the Sheriff's responsibilities and if given
to the District Attorney's office they will prosecute.
