The Board of County Commissioners of Kay County, Oklahoma, met
in regular session at 9:00 o'clock a.m. on Monday, July 23, 2007,
in the Commissioners Court of the Kay County Courthouse in Newkirk,
Oklahoma. Notice of the meeting was posted for public information
on July 20, 2007, at 8:30 a.m. at the Courthouse front door,
Commissioners Court, and basement handicapped entrance of the
Kay County Courthouse in Newkirk, Oklahoma.
Chairman Schieber called the meeting to order. Those present
were as follows: Dee Schieber, Chairman; Laile Wilson, Vice-Chairman;
Wayne Leven, Member; Will Clark, First Assistant District Attorney
(ADA); Judy Barnes, Kay County Assessor; Christy Kennedy, Kay
County Treasurer; Mary Ramey, Kay County Court Clerk; Everette
Van Hoesen, Kay County Sheriff; Carol Kellum, Kay County Election
Board; Larry Klumpp, OSU Extension; Charles Abbott, Blackwell

Jail Issues: Sheriff Van Hoesen reported the daily inmate
count showing 132 and reported the average for the month as 134.
Sheriff said all three of the escapees, from the recent
jail escape, are now in custody and the door from which they
escaped has been repaired and sheriff's vehicle removed.
Commissioner Leven asked the Sheriff if they were taking light
readings. Sheriff replied. "they tear them up
faster than we can fix."
Sheriff also reported he thought Sweeper Fabricators would be
coming next week to finish working on the doors (he said Sweeper's
is saying the problem is electrical).
Motion was made by Leven and seconded by Wilson approving Chairman
Schieber to sign Oklahoma Juvenile Claim in the amount of $3,224.39.

permit submitted by SemCrude Petroleum, Dist#3. Wilson

Bridge EWP Project to shape and riprap the sides of the channel

and will be required to provide a minimum of 25% of the total
installation cost as cash or in-kind services. Motion carried:

and cross beneath fifteen county roads beginning in Section 32
T25N R1W crossing diagonally across the county to Section 19

Illegal Trash Dumping: Will Clark, First Assistant District
Attorney, addressed this issue referencing Oklahoma Statutes
Title 21, Section 1753.3. Throwing, dropping, depositing,
or otherwise placing any litter from a vehicle upon highways,
roads, or public property. Any person convicted of violating
these provisions shall be subject to a state traffic offense
punishable by a fine of not more than $1,000.00. Clark
mentioned if the litter is a flaming or glowing substance the
penalties may go up to $2,000.00. Clark said any person
violating these provisions shall be deemed guilty of a misdemeanor.
Clark referenced Oklahoma Statutes Title 21, Section 1761.1.
Dumping, etc. of trash on public or private property prohibited-penalties.
Clark said citizens may report to law enforcement, a State Highway
Patrol, a county sheriff or deputy, a municipal law enforcement
officer or any other peace officer in this state. If warranted,
the peace officer shall then conduct an investigation into the
allegations. If the person committed the violation, a report
shall be filed with the District Attorney for prosecution.
Clark said the discovery of two or more items which have been
dumped, discarded, etc. and bear a common address identifying
the latest owner of the items shall create a rebuttable presumption
and can presume the person committed the unlawful act.
Citizen, Orva Rothgeb, said the number one way to get this problem
stopped is to enforce fines and let the people know you mean
business. Ms. Rothgeb mentioned several suggestions on
how she feels the problem should be handled. She also suggested
to the commissioners to enforce stricter regulations and to make
the fines bigger. Rothgeb added she is not faulting the
sheriff.
Clark said the fines can only be what were in the State Statutes.
Unscheduled public appearances: Buddy Thomas, Undersheriff,
said the jail is in bad shape, it is unsafe and he stated someone
is going to be killed. Thomas told the group in attendance
how the inmates were able to get contraband in the jail.
Bruce Robinson, Chairman of the Justice Facilities Authority
(JFA), said he would like to clear up some misunderstanding.
He referenced a comment made in the Ponca City News, July 20,
2007, about the JFA moving so slowly. Robinson said we,
the JFA, have not been given the authority to do anything; we
are a fact finding committee. He said the JFA has diligently
hired a Jail Consultant and will hire an architect to view the
jail facility. Robinson said the JFA has been well represented
in the commissioners meetings. He said most of the trustees
that serve on the JFA are working people who work 8-5 jobs.
Robinson said he did not appreciate comments made about the JFA
moving so slowly. Most importantly, Robinson said he wanted
the citizens of Kay County to understand how hard they are working.
He also wanted it known the JFA has never turned in a claim
for any travel expenses.
Commissioner Wilson and others mentioned how much they appreciate
the JFA members. Wilson mentioned the Justice Facilities
Authority is a volunteer board who is working very hard.

The commissioners heard the Estimate of Needs, concerns and requests

Fair Board; OSU Extension; District Attorney. The Sheriff
was unable to present his requests (prior engagement) and will
speak to the Board of Commissioners next week.

The Board of County Commissioners of Kay County, Oklahoma, met
in special session at 2:30 p.m., Wednesday, July 25, 2007, in
Courtroom "C" located on the Third Floor of the Kay
County Courthouse in Newkirk, Oklahoma. Notice of the meeting
was posted for public information on July 23, 2007, at the Courthouse
front door, Commissioners Court, Courtroom "C", and
basement handicapped entrance of the Kay County Courthouse in
Newkirk, Oklahoma.
Chairman Schieber called the meeting to order. Those present
were as follows: Vice-Chairman Laile Wilson; Wayne Leven,
Member; Tammy Reese, County Clerk/Secretary (see sign-in sheet).
A joint meeting was held between the County Commissioners and
the Justice Facilities Authority to discuss with Don Garrison,
Oklahoma State Department of Health Jail Inspection Division
(OSDH), jail issues.
Both boards welcomed Don Garrison. Commissioner Leven opened
the discussion by saying they were meeting to discuss jail issues
and recent escape.
Garrison began by asking the Justice Facilities Authority if
they had seen the report made by the National Institute of Corrections.
He said two guys spent one week in the jail and gave a good report
of the current jail. Garrison said since that time he has
been hearing a lot of talk but hasn't seen much action from the
Commissioners and the Sheriff. He reminded the group of
the Administrative Compliance Order and fine of $95,000.
He said the jail was still overcrowded and understaffed.
Garrison said he recently told his Legal Department that nothing
had changed and they needed to revisit Kay County's situation.
Garrison told both boards they have interviewed some good architect
firms. He stated he has worked with all of them to some
degree and they are all capable people. He said you can't
study this thing to death. Garrison said OSDH has waited
for one year on the Commissioners and Sheriff to do something
and added they better address this matter as soon as possible
or drastic action will be taken by the OSDH.
The escape of the three inmates was addressed by Garrison.
Garrison said someone is not paying any attention in the jail
when inmates can tear a concrete step off and then beat on a
steel door and no one even realize anything was going on.
He said someone wasn't doing their job. He again said,
some action better be taken and very shortly or drastic action
will be made; this is a vital situation that has taken over one
year. That is where we are!
Garrison then made a suggestion to the Sheriff telling him he
needed to read a book on how to be an effective Sheriff along
with a guide for Jail Operations. He said an administrator
must see that the work gets done and if not find someone who
will. Garrison told the Sheriff he must know the policies
and procedures and his employees must know them also. He
said you need to understand your problems and know how to avoid
them.
Attorney Brent Clark said it might be helpful to know the steps
involved in closing a jail.
Garrison explained the steps. He said we have already been
through Administrative Compliance and have violated rules and
owe money. If no progress is made and it looks like you
are not going to, I will ask the legal staff and the commissioner
of health to contact the Attorney General to close the facility.
Garrison said, "And today I would have the grounds to close
this facility." Then you would need to take the inmates
to another facility and it would cost the county a lot of money
and you do not want this to happen. "It's imperative
to move as soon as possible," Garrison said.
Other topics discussed: The procedure and process of hiring
a Jail Administrator, renovation, hiring quality people to work
in the jail.
Motion was made by Leven and seconded by Wilson to adjourn (3:30
